COACHING AGREEMENT - TERMS OF SERVICE
It is common practice for naturopaths, nutritionists, and other non-licensed practitioners to collect your signature on a form such as this. By doing so you acknowledge and accept that Faith M. Davis, as an Integrative Healing Practitioner:
- is not medically qualified;
- is not a substitute for advice from a qualified doctor;
- recommends that you consult your doctor before making any changes to your diet or exercise regime or taking any dietary supplement;
- does not warrant the accuracy of any information provided;
- is not liable for any losses you may suffer by relying on information given;
- does not recommend any particular product;
- is not a covered entity or a business associate of a covered entity under HIPAA (USA)
By signing these Terms of Service or by instructing Faith M. Davis to provide services to you, you indicate your agreement to these terms.
WHAT INTEGRATIVE HEALING PRACTITIONERS DO AND DO NOT DO
Faith M. Davis, as an Integrative Healing Practitioner obtains laboratory test results and provides you with a nutritional interpretation of those test results that you can use exclusively as an educational tool for personal health purposes.
Your doctor may use the same test results to diagnose and treat disease, but Faith M. Davis, as a Integrative Healing Practitioner, does not do this. The information Faith M. Davis provides is not intended to, cannot, and should not be expected to be a substitute for a personal consultation with your own qualified doctor. Faith M. Davis does not accept any liability for any failure to identify any medical condition or disease; this is not the purpose of Faith M. Davis’s services.
Faith M. Davis as an Integrative Healing Practitioner may provide you with information relating to products that she believes might benefit you, but such information is not to be taken as an endorsement or recommendation. Some such products may not be available without a prescription, but she does not dispense or prescribe any prescription products. The information provided is intended for educational purposes only and should not be taken as professional medical advice or used as a substitute for medical care. Faith M. Davis is not responsible for any adverse affects or consequences that may result, either directly or indirectly, from that information.
Faith M. Davis, as an Integrative Healing Practitioner, will make reasonable effort to protect the privacy of your medical information that is shared with us, including any medical test results.

EXCLUSION OF WARRANTIES
Faith M. Davis, as an Integrative Healing Practitioner, will provide her services to you with reasonable care and skill. But she makes no other warranty, express or implied, with respect to those services. All other warranties are excluded to the maximum extent permitted by law.
Faith M. Davis, as an Integrative Healing Practitioner, makes no warranty as to the accuracy of the laboratory test results she receives.
Faith M. Davis, as an Integrative Healing Practitioner, makes no warranty, expressed or implied, as to the quality or effectiveness of any diagnosis, apparatus, treatment, or product. In no event, will Faith M. Davis be liable for any physical or mental injury, or any negative side effects, that may arise from the use of any such diagnosis, apparatus, treatment, or product.
Faith M. Davis, as an Integrative Healing Practitioner, believes that the information she provides, including that on our web sites, brochures, flyers, and information packets, is accurate, but she cannot guarantee such accuracy. Faith M. Davis therefore makes no warranty as to the accuracy of that information, and it should not be relied upon as being correct, complete, or accurate. It is your responsibility to verify such matters independently from primary sources of information and by taking specific professional advice.
EXCLUSION OF LIABILITY
If you rely on, buy, or use a product or therapy, you do so at your own risk. Each person is different, and the way someone reacts to a product or therapy may be significantly different from another. Faith M. Davis, as an Integrative Healing Practitioner, cannot predict how you may react to any product or therapy.
To the maximum extent permitted by law, Faith M. Davis and Holistic Health & Spirituality, LLC excludes:
- any and all liability in contract, tort (including negligence), breach of statutory duty or otherwise for any direct, indirect, special, incidental, or consequential costs, losses, claims, damages, expenses or proceedings (including but not limited to loss of profits and wasted management time) incurred or suffered by you arising directly or indirectly out of or in connection with her services, including but not limited to any loss, damage or expense arising from any defect, error, imperfection, fault, mistake or inaccuracy with the information or advice she provides;
- any and all liability for injury or loss arising out of the use of, or reliance on, the laboratory results and/or the dietary, energetic, supplement and lifestyle suggestions she may provide.
- any and all liability for injury or loss arising from any product or treatment you may choose to take.
- any and all liability for any failure to identify any medical condition or disease. You understand and agree that this is not the purpose of her services.
This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
NO RECOMMENDATION
All material and information Faith M. Davis may provide about products and therapies is provided solely for educational purposes and for use when discussing your health with your doctor. By providing you with such material and information, she does not necessarily endorse, recommend, or promote any such product or therapy.
DESCRIPTION OF SERVICES
During the Term of this Agreement, Faith M. Davis will provide the client with Integrative Healing Services and/or Bioenergetics services and/or Energy Healing services.
SERVICE LOCATION
The Service to be provided under this Agreement shall be performed at the Practitioner's place of business. (i.e. Home Office). Contact with client will be over the phone, skype, email, text or Facebook.
SCHEDULE AND DAYS OFF
Faith M. Davis is generally available to provide Services during normal business hours. Monday thru Friday 9am – 4:00pm EST, excluding holidays. Faith M. Davis will make every effort to return messages within 24 hours. In the event that Faith M. Davis will be unavailable due to vacation or other foreseen events, every effort will be made to give reasonable notice.
PAYMENT FOR SERVICES
Faith M. Davis shall perform the Services based on the details outlined in the online description of services. Any discounts will be reflected online.
REFUND POLICY
Your success depends primarily on your own dedication, effort, commitment, and follow-through. There are no guarantees that you will attain a health goal, and you accept and understand that results differ by each person. As with any health-based program or service that you purchase, your results may vary, and will be based on many variables, so therefore no guarantees can be made. All services are non-refundable for this reason. There will be no refunds or credits for partial months of service, or refunds for months unused with an open account.
TERM/TERMINATION
This Agreement takes effect on date of signing, unless otherwise stated and continues for as long as the client engages in services with Faith M. Davis, unless terminated. Termination: Faith M. Davis may terminate this contract at any time if the client threatens, if the client is verbally abusive, or if the client is manipulative. Faith M. Davis may terminate this contract at any time if the client posts her protocols on social media or the internet without permission. Faith M. Davis may terminate this contract at any time if the client follows other protocols that Faith M. Davis feels will cause damage to their body or is constantly adding in extra supplements, drugs, or other protocols. No refund or credits will be given for unused time.
